...הוד כבור ידידי הרב הגאון הגדול... אחד"ש רומעכת"ר שי", הנה הגיעגי מהבד"צ בלאנדאן מחברה , לקרא לאסורים דרור" חתום עליו ,יוסף שאפאטשניק חופ"ק לאנדאן" ועוד איזה רבנים בלתי ידועים, המחברת שלחתי ע"י פאסט לכת"ר.

והנה כל קורא ומעיין יבהל וישתומם על המתיר איסורים חמורים לאו דיבמה לשוק בלי שום יסוד ושרש בהלכה. ובאותיות גדולות כתוב שם וכל יבם גמי כשאינם יכולים להתקרב ולהיוה ביחד אינה צריכה חליצה, כיון דלא שייך גבי טן דן . תולה א"ע בהרה"ג מו"ה אהרן וואלקין נ"י רב בפינסק וכאשר שואלתי להנ"ל השיבני כי לא חי' רברים מעולם ושלח העתק תשובתי המחבר הנ"ל בדה מלבו שהוא ראש לאגודת רבנים יחידי בתבל של מ"ה רבנים וקורא את העגונות האמללות שיצילן מכבלי העיגון.

וכאשר שלחו מחאות הגה"צ החפץ חיים ואני בשם ועד הרבנים דקהלתנו, וגם ועד הרבנים בווארשא, השיב בעתון הלאנדאני "די צייט" בעזות, והעתיק חלק ממחברתו בלשון יהודית, והעיקר אצלן שיש ביד רבני זמננו להפקיע קדושין, וגם ערך סמרטוט מיוחד לבזות את הגה"צ החפץ חיים שי' המתנגדים לדבריו הם החולקים על דברי הראשונים והם פושעי ישראל, ותולה א"ע גם בקוצו של יוד מי.ל.ג אשר בשביל חומרות הרבנים יצא להרבות רעה. והמכשלה גדולה בימינו

אלה אשר דבר החליצה כקוץ בעיני החמשים וימצאו אילן סרק לתלות בו, ועל כן נחוץ אשר כל הרבנים גדולי זמננו יפרסמו דבריהם שאין לסמוך על הוראות שאפאטשניק לא בעניני עגונות ולא בשארי הוראות, את המחאת ישלחו להבד"צ בלאנדאן או אלי ואמציא לידם .

את זה אשר מצאתי להעיר ולבקש את הדר"ג שי" ואו"ט וברכה לרומעכת"ר

ולכל הנלוים אליו לאהבה אותן בנפשו היקרה וכנפש מוקירו ומכבדו הדוש"ת

With God’s Help, 2nd of Shevat 5688 (1928)

…His Excellency, my dear esteemed Rabbi, the great genius… may his honor be elevated, here is what has arrived from the London Beit Din (Rabbinical Court) regarding a booklet titled "Call for the Release of the Forbidden," signed by "Yosef Shapotshnik, head of the London Beit Din" and some other unknown rabbis. I sent the booklet by post to Your Honor.

And behold, any reader and examiner will be shocked and astonished by the one who permits severe prohibitions, such as allowing a widow to remarry without proper halachic basis. In large letters, it is written there that any yavam (levirate husband) and yevama (levirate widow) who cannot come together and unite do not require halitza (ritual release), as it is not relevant in this context. He bases himself on Rabbi Aaron Walkin of Pinsk, and when I inquired of him, he replied that he never made such statements and sent a copy of his response. The author of the booklet falsely claimed to be the head of an association of rabbis numbering 45 and called upon the unfortunate agunot (women chained to their marriage) to be freed from their marital bonds.

When the great and righteous Chofetz Chaim and I, in the name of the Rabbinical Council of our community, along with the Rabbinical Council of Warsaw, sent protests, he responded in the London newspaper "The Times" with insolence, quoting parts of his booklet in Yiddish. His main argument is that contemporary rabbis have the power to annul marriages, and he even composed a special leaflet to slander the great and righteous Chofetz Chaim, claiming that those who oppose his views are disputing the early sages and are sinners of Israel. He also falsely attributes his claims to the strictness of the rabbis, which has caused much harm.

The stumbling block is great in our time. Those for whom the matter of halitza is like a thorn in their eyes will find a weak tree to hang on. Therefore, it is necessary for all great rabbis of our time to publicize their statements that Shapotshnik's rulings should not be relied upon in matters of agunot or any other instructions. Their protests should be sent to the London Beit Din or to me, and I will forward them.
